Terms of Service

These Terms of Service ("Terms") govern your access to and use of SHSQ Maestro, the Safety, Health, Sustainability & Quality (SHSQ) management platform operated by the platform operator ("we", "us"). By creating an account or using SHSQ Maestro, you agree to these Terms.

1. Eligibility & accounts

You must be authorised to act for your organisation. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.

2. Licence & acceptable use

We grant you a limited, non-exclusive, non-transferable licence to use SHSQ Maestro for your internal SHSQ management purposes, subject to your active subscription. You agree not to misuse the service, upload unlawful content, attempt to disrupt the platform, or access data you are not authorised to access.

3. Your data & content

You retain ownership of the data you submit to SHSQ Maestro. You grant us a licence to host, process and display that data solely to operate the service for you. You are responsible for the accuracy and lawful processing (including under POPIA) of the personal information you enter.

4. Subscriptions & fees

Access to paid features is provided under a subscription as described in the "Subscriptions & Billing" section below. Fees, billing cycles and feature tiers are published on our pricing page. We may change fees with reasonable advance notice; changes take effect at your next renewal.

5. Service availability

We strive for high availability but do not warrant uninterrupted service. Maintenance, updates and outages may cause temporary unavailability. The service is provided "as is" and "as available" without warranties beyond those required by law.

6. Limitation of liability

To the extent permitted by South African law, the platform operator shall not be liable for indirect, incidental or consequential damages, or for loss of profits or data, arising from your use of SHSQ Maestro. Our aggregate liability is limited to the fees you paid in the 12 months preceding the claim.

7. Termination

You may stop using SHSQ Maestro and cancel your subscription at any time per the Cancellation Policy. We may suspend or terminate access for breach of these Terms, unpaid fees, or unlawful use.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email; continued use after the effective date constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the competent courts of South Africa unless otherwise agreed.

Subscriptions & Billing

SHSQ Maestro is offered as a tiered subscription with monthly and annual billing cycles. Plans and pricing are shown on our pricing page and may be changed with reasonable notice.

Plans & tiers

  • Starter — core SHSQ reporting for a single site, up to 5 users.
  • Professional — full SHSQ management across unlimited sites, up to 50 users.
  • Enterprise — advanced document control, GHG monitoring and unlimited users.

Billing

Subscriptions are billed in advance for each period: monthly plans cover one month and annual plans cover a year. Renewals are manual — we'll email you before your period ends and you choose when (and how) to renew from the Billing page; you are never charged automatically. Payments are processed securely by Payfast, and you can pay by card, Instant EFT, mobile wallet or any other method offered at checkout. Each plan applies account-wide: the administrator who activates the plan sets the tier for all users on the account.

Upgrades & downgrades

You can change your plan at any time. Upgrades take effect immediately and are reflected on your next renewal. Downgrades take effect at the end of the current billing period so you retain paid access for the period already paid.

Activation

Plans are activated by an account administrator from the Plans page. Activation records the plan, billing cycle and renewal date on your account.

Refund Policy

We want you to be confident in your subscription. This policy explains when refunds are available.

14-day money-back guarantee

If you are a new subscriber and are not satisfied with SHSQ Maestro, you may request a full refund within 14 days of your first payment, provided you have not materially used the paid features (e.g. generated reports or records beyond basic evaluation). Contact us with your account email and we will process the refund.

Annual plans

For annual subscriptions, refunds after the 14-day guarantee are considered on a pro-rata basis for the full unused months remaining in your annual term, less any setup or onboarding fees that have been delivered. Approved pro-rata refunds are paid to your original payment method within 10 business days.

Monthly plans

Monthly subscriptions are non-refundable for the current month once the 14-day guarantee period has passed. You will retain access until the end of the paid month and will not be charged again after cancellation.

Non-refundable items

  • Onboarding, training or professional services already delivered.
  • Refunds requested after the guarantee period for monthly plans.
  • Downgrades or partial-month unused time on monthly plans.

How to request a refund

Email us with your account details and the reason for the request. Approved refunds are returned to the original payment method. This does not affect your statutory consumer rights under South African law.

Cancellation Policy

You may cancel your SHSQ Maestro subscription at any time. There are no cancellation fees.

How to cancel

An administrator can cancel from the Billing page by selecting "Cancel subscription". Cancellation takes effect at the end of the current billing period.

Effective date & continued access

When you cancel, you keep access to all paid features until the end of the period you have already paid for (the period-end date shown on your Billing page). No further charges are ever made — renewals only happen when you pay for them yourself.

What happens to your data

After cancellation, your data is retained for at least 30 days so you can export it. After this grace period, access to paid features is removed and premium modules become locked. Your account and basic reporting access remain available unless you also delete your account.

Reactivating

You can re-subscribe at any time from the Plans page. If you re-subscribe within the data-retention window, your previous data and configuration remain intact.

Refunds on cancellation

Cancellation stops future billing. Refunds for the cancelled period are handled per the Refund Policy above — generally monthly plans are non-refundable for the current month, and annual plans may qualify for a pro-rata refund for unused full months.

Delivery Timeline

SHSQ Maestro is a digital (software-as-a-service) product. "Delivery" of the service happens electronically and instantly upon subscription activation — there are no physical goods shipped.

Service activation

Once a plan is activated by an administrator, paid features are available immediately (within a few minutes while the subscription status syncs across the app).

Onboarding (Enterprise)

Enterprise plans include dedicated onboarding. We aim to schedule and begin onboarding within 3 business days of activation, and complete standard onboarding within 10 business days.

Professional services & training

Any separately purchased training, configuration or implementation services are delivered per the agreed scope, typically within 5–15 business days depending on scope. A delivery schedule is confirmed in writing at purchase.

Support response

  • Starter: email support, best-effort response within 2 business days.
  • Professional: priority email support, response within 1 business day.
  • Enterprise: priority support with SLA, response within 4 business hours on business days.

Access credentials

Account access is delivered via email invitation. Users receive their invite immediately after being added by an administrator.
